Terms of Use

Psyhelp does not provide emergency or crisis services. The Psyhelp application and website are not designed for situations where you may be at immediate risk of harm.

These Terms of Use (the “Terms”) apply to your use of the Psyhelp mobile and web applications, and all related services made available by or on behalf of Psyhelp (“Psyhelp”, “we”, “us”, or “our”).

By tapping “Accept”, “I agree”, creating an account, or by using Psyhelp in any way, you are agreeing to these Terms. If you do not agree, you must not use the Psyhelp application or related services.

THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION AND A WAIVER OF CLASS ACTIONS, WHICH AFFECT YOUR RIGHTS IN THE EVENT OF A DISPUTE. PLEASE READ SECTION 12 CAREFULLY.

1. General Provisions

1.1 Definitions

For purposes of these Terms, the following definitions apply:

  • “Application” means the Psyhelp mobile app and any related web-based or successor applications we make available.
  • “Services” means all self-therapy, mindfulness, conversational, and related features delivered through the Application or our websites, including AI-assisted conversations that guide you through self-help methods, reflection, and emotional support.
  • “Content” means all text, graphics, images, audio, video, exercises, summaries, and other materials provided through the Services, as well as any comments, feedback, or submissions from users.
  • “Feedback” means any ideas, suggestions, reviews, or comments you provide about Psyhelp or the Services.
  • “Subscription Term” means the period during which you have access to paid features of Psyhelp, as chosen by you (for example, monthly or yearly) in the app store or other purchase flow.
  • “User” or “you” means an individual who accesses or uses the Application or Services.

1.2 Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above and may provide additional notice in the Application or by email. Unless otherwise stated, the updated Terms will apply to all use of the Services after they are posted. If you continue to use Psyhelp after the Terms are updated, you are agreeing to those changes.

2. User Consents

2.1 Electronic Communications

You agree that Psyhelp may contact you electronically in connection with providing and operating the Services. This may include in-app messages, push notifications, emails, or SMS messages. Your mobile or internet provider may charge you for data or messaging associated with these communications.

The Application may request certain permissions on your device (for example, internet access or notification permissions) to function correctly. Granting these permissions may use data or battery power. Using Psyhelp on “jail-broken” or otherwise modified devices may cause problems and is considered a breach of these Terms.

2.2 Privacy

To provide the Services, we collect and process information about you, including information you enter into the Application and data generated during your interactions with Psyhelp (“Your Information”). Depending on your choices, Your Information may include text or voice conversations, reflections, and other emotional or contextual information you choose to share.

If you opt in, some of Your Information may also be used to train, evaluate, or improve our AI models and to develop new features, always according to our Privacy Policy. Your Information may be stored and processed by trusted service providers who support the operation of Psyhelp.

2.3 Children and Age Restrictions

Psyhelp is intended for adults. We do not knowingly collect personal information from children under 13. If you are under 13, you must not register for or use Psyhelp. If we learn that we have collected personal information from a child under 13, we will delete it as soon as reasonably possible and may close the associated account.

3. Your Representations and Acknowledgements

3.1 Your Representations

  • You are at least 18 years old and have the legal capacity to agree to these Terms.
  • The information you provide to Psyhelp is accurate and not misleading, and you will keep it up to date.
  • You will use the Services only in accordance with these Terms and with applicable laws. You will not use Psyhelp to harass, abuse, or harm others, or for any unlawful activity.
  • You will not use automated tools, bots, scrapers, or data-mining tools to access or interact with the Services.
  • You will not attempt to interfere with or damage the Application or Services, including by introducing malware, circumventing security, or overloading our systems.
  • You will not sell, rent, or commercially exploit the Services.

We may take legal or technical steps, including involving law enforcement, to investigate or respond to misuse of the Services.

3.2 Important Acknowledgements

  • Psyhelp is not a healthcare provider and does not practice medicine, psychotherapy, or psychiatry. Psyhelp provides self-help and well-being tools only.
  • No clinician-patient or therapist-client relationship is created between you and Psyhelp by your use of the Services.
  • Psyhelp is not a substitute for in-person or professional mental health care, diagnosis, or treatment. You remain responsible for seeking medical advice from qualified professionals whenever needed.
  • You may incur charges from your internet, data, or mobile provider when using the Application.
  • Paid subscriptions may not be reimbursable by insurers or public health programs unless explicitly stated.
  • Some features may only be available in certain regions, and access may depend on your location.

4. Registration and Account Creation

Some parts of Psyhelp may require you to create an account. When you register, you may be asked for information such as your name, contact details, and certain background information relevant to your use of the app.

You agree to keep your login details confidential and not to share them with anyone else. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, you should notify us immediately.

We may apply additional security measures from time to time (for example, multi-factor authentication) to help protect your account and the Services.

5. Ownership and License to Use the Services

5.1 Ownership

Psyhelp (or its licensors) owns all rights, title, and interest in and to the Application, Services, Content, and all related technology, designs, and intellectual property (collectively, “Service Content”). You do not acquire any ownership rights in Psyhelp or the Service Content by using the Services.

5.2 Limited License

As long as you comply with these Terms and any applicable subscription conditions, Psyhelp grants you a personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Application and to access the Services for your own personal, non-commercial use. Any use of the Services beyond what is expressly permitted in these Terms is prohibited.

6. User Information

Any information, text, audio, or other material you submit or share through the Services is referred to in these Terms as “User Information”. Except for the rights you grant to us below, you retain ownership of your User Information.

By using Psyhelp, you give us a worldwide, royalty-free, sublicensable, irrevocable license to use, host, store, reproduce, modify, translate, and create derivative works from your User Information as necessary to operate, maintain, and improve the Services. This includes generating summaries, insights, and reflections for you, and, if you have opted in, using de-identified information to improve our AI models and future products.

If you delete your account, we will no longer show your User Information in the Application under that account. However, some data may persist in backups or logs, and we may retain certain information where required by law or for legitimate business purposes.

We may, but are not required to, monitor or remove User Information that we believe violates these Terms or the law.

7. Subscription Fees

Some features of Psyhelp are available only with a paid subscription (“Subscription Fees”). Pricing and available plans are shown in the Application or in the relevant app store. Unless stated otherwise, Subscription Fees are non-refundable, even if you stop using the Services before the end of your Subscription Term.

Payments are generally processed through third-party platforms (such as Apple App Store or Google Play) or payment providers. Your purchase and renewal will be governed by the terms and policies of those providers in addition to these Terms.

You are responsible for any taxes or charges imposed by your jurisdiction in connection with your Subscription Fees, other than taxes based on Psyhelp’s income.

8. Term and Termination

These Terms apply from the time you first accept them or start using the Services and continue for as long as you use Psyhelp or have an active subscription.

We may suspend, limit, or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, misused the Services, or where we decide, in our discretion, to discontinue some or all of the Services. If we stop making the Services available in your region during your paid Subscription Term, we may provide a pro-rated refund of any prepaid fees for the unused portion of your subscription.

You may stop using Psyhelp at any time. Uninstalling the application or cancelling a subscription through your app store stops future billing but generally does not entitle you to a refund for the current billing period, unless required by law or explicitly stated otherwise.

9. Disclaimer of Warranties

Psyhelp aims to provide helpful, high-quality tools. However, other than what is expressly stated in these Terms, the Application and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we and our affiliates make no express or implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

Psyhelp does not provide medical advice, diagnosis, or treatment. Our content and tools are for general well-being and educational purposes only and must not be relied upon as a substitute for professional care from a licensed clinician. You are responsible for seeking professional medical or mental health advice when needed and for deciding how to act on any information obtained through the Services.

Like other AI-based tools, Psyhelp’s AI outputs may at times be incomplete, inaccurate, or inappropriate. You should not rely on any factual statements in the output without independent checking, and you should always use your own judgment and seek professional advice where appropriate.

Any third-party websites or resources that we link to are provided for convenience only. We do not endorse and are not responsible for their content, products, or services.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Psyhelp and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Application or Services, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claims arising out of or relating to these Terms or the Services will not exceed the greater of: (a) the amount you paid to Psyhelp for the Services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations of liability or exclusion of certain damages; in such cases, these limitations may apply to you only to the extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Psyhelp and its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any User Information you submit.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where Psyhelp is established (without regard to conflict-of-laws rules), unless a different law is required by the consumer protection rules of your country of residence.

To the extent permitted by law, any disputes or claims arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration rather than in court. You and Psyhelp each waive any right to a jury trial and to participate in a class or representative action. If arbitration is not enforceable for a particular dispute, you agree that such dispute will be brought exclusively in the courts of the jurisdiction where Psyhelp is established.

13. Miscellaneous

  • App stores. If you downloaded Psyhelp from the Apple App Store or Google Play, your use of the Application is also subject to their terms and conditions. They are not responsible for providing support for Psyhelp.
  • Survival. Provisions that by their nature should survive termination of these Terms (for example, limitations of liability, indemnity, and dispute resolution) will continue to apply after you stop using the Services.
  • No waiver. If we do not enforce a right or provision in these Terms, that does not mean we waive it permanently.
  • Severability. If any part of these Terms is held to be invalid or unenforceable, the remaining parts will continue in full force and effect.
  • Assignment. You may not assign or transfer these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, or by operation of law.
  • Entire Agreement. These Terms, together with any additional policies referenced in them (such as our Privacy Policy), form the entire agreement between you and Psyhelp regarding the Services.
